LiveChannel Platform Privacy Policy – Consumer Services Version

Privacy Policy Overview

Goodwell Technologies, Inc. and our affiliates and subsidiaries ("Goodwell," "we" or "us") take your privacy seriously. You should take the time to read our Privacy Policies (the “Policies”) to understand how we collect, use, and share personal information.

The following explains how we collect, use, and disclose personal information for services we provide directly to you as a consumer, including in connection with https://livechannel.io (“Consumer Services”). Our Consumer Services are typically offered as part of a co-branded experience with our e-commerce retail partners (Retail Partners). We may also process your data on behalf of those Retail Partners, and this policy does not apply to those activities. You can visit the LiveChannel Platform Privacy Policy – Business Services Version and those Retail Partners’ privacy policies to learn more about those activities. These policies do not apply to visitors to the Goodwell corporate websites (including www.goodwelltech.com), and they do not cover the practices of third-party partners such as our service providers, third party advertisers, or any social networking platforms, or any other third parties other than our service providers. For information about third party privacy practices, please consult their privacy policies.

Personal Information We Collect

The personal information we collect in connection with our Consumer Services depends on how you interact with us, the parts of our Consumer Services you use, and the choices you make. We collect and process personal information about you with your consent and/or as necessary to provide the Consumer Services for your use, operate our business, meet our contractual and legal obligations, protect the security of our systems and our customers, or fulfil other legitimate interests.

We collect information about you in various ways when you use our Consumer Services, including information you provide directly, information collected automatically, and third-party data sources.

Information you provide directly. We collect personal information you provide to us. For example:
  • We collect your personal information when you engage with or register for our Consumer Services, such as contact information (e.g., name, email address, postal address, phone number, fax number) and information about your purchase history (e.g., billing and shipping address, products and services purchased from and through our partners, and types of payment used).
  • We may collect your personal information such as contact information when you contact us for assistance, or when you indicate that you are interested in hearing from us or one of our partners;
  • We may also collect your demographic information (age, occupation, role(s), etc.) to personalize and improve our Consumer Services and for marketing purposes.

Information collected automatically. As further described in the Use of Cookies and Similar Technologies section below, when you use our products and services, some information is collected automatically. For example, when you visit our sites used for our Consumer Services, our web servers automatically log your computer's operating system, Internet Protocol (IP) address, access times, browser type and language, the website you visited before our site, and your activity on our sites.

Third-party sources. We also obtain information from third parties. We protect information obtained from third parties according to the practices described in this policy, plus any additional restrictions imposed by the source of the information. These third-party sources may include:
  • Retail Partners with whom we offer co-branded services and other partners with whom we engage in joint marketing activities;

When you are asked to provide personal information, you may decline. But if you choose not to provide information that is necessary for certain products or features, those products or features may not be available or function correctly.

Use of Cookies and Similar Technologies

Our websites use "cookies" that are small files stored on your computer to allow us to better understand which pages our users visit, what they do when they visit those pages, and how much time they spend there.

In addition, our websites may contain other technologies to track user behavior, such as “web beacons” (also called single-pixel gifs) which we use to help deliver cookies on our websites, tell us which parts of a page are visited or used and gather usage and performance data. We may also include web beacons in our promotional email messages or newsletters to determine whether you open and act on them. In addition, we may gather certain information automatically, such as Internet Protocol (IP) address, browser types, Internet Service Provider (ISP), the website you visited before our site, operating system, device specifications, date / time stamp and clickstream data. We use this information to analyze trends, to administer our Consumer Services, to track users’ movements around our websites and to gather demographic data about our user base as a whole.

Our websites may include web beacons and cookies from third-party service providers. In some cases, that is because we have hired the third party to provide services on our behalf, such as site analytics. In other cases, it is because our websites contain web beacons used to track interaction with and effectiveness of content (such as videos and informational content) or ads from third parties. Our Retail Partners may also engage in similar activities on our co-branded sites. Because your browser connects to those third parties' web servers to retrieve that content, those third parties are able to set or read their own cookies on your device and may collect information about your online activities across websites or online services

The third-party analytics providers we use include: Google Analytics and Microsoft Application Insights. Many third-party analytics providers allow you to opt-out from their collection or use. For more information, click on the links above.

You can also use browser controls to limit how the websites you visit are able to use cookies. Instructions for blocking or deleting cookies may be available in each browser's privacy or help documentation. Please be aware that if you choose to block cookies, certain website features that depend on cookies may no longer function. If you choose to delete cookies, settings and preferences controlled by those cookies, including advertising preferences, may be deleted and may need to be recreated.

  • Improve and develop our Consumer Services;
  • Personalize our Consumer Services and make recommendations, and understand you and your preferences to enhance your experience and enjoyment using our Consumer Services;
  • Send you information, including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages;
  • Advertise and market to you (see the Use of Cookies and Similar Technologies section of this policy for information about your advertising choices), including sending promotional communications, targeting advertising, and presenting offers to you, such as new products, offers, rewards, contests, upcoming events, and other information about our products and services and our selected partners’ products and services;
  • Operate our business, such as improving our internal operations, securing our systems, and detecting fraudulent or illegal activity.

Why We Share Personal Information

We share your personal information with your consent or as necessary to complete any transaction that you have requested or to support the purposes described in this policy. For example, when you choose to use our Consumer Services to make a purchase from or through our Retail Partners, we will share that data with our Retail partners to help them fulfill your transactions, support returns and customer services, and other purposes described in their privacy policies.

In addition, we share personal information among our affiliates and subsidiaries. We may also share certain personal information about you to companies working on our behalf for the purposes described in this policy. These companies may help us process information, fulfill or deliver orders, manage and enhance customer data, provide customer service, assess your interest in our products and services or conduct customer research or satisfaction surveys. In such cases, these companies must abide by data privacy and security requirements and are not allowed to use personal information they receive from us for any other purpose. We may also disclose and transfer personal information as part of a corporate transaction such as a merger, transfer, divestiture, or sale of all or a portion of our business or assets.

Finally, we will access, transfer, disclose, and preserve personal information when we belief that doing so is necessary to:
  • comply with applicable law or respond to valid legal process, including from law enforcement or other government agencies;
  • protect our customers, for example to prevent spam or attempts to defraud users of our products, or to help prevent the loss of life or serious injury of anyone;
  • operate and maintain the security of our products, including to prevent or stop an attack on our computer systems or networks; or
  • protect our rights or property, including enforcing the terms of our agreements.

How You can Access and Control Your Personal Information

Access, extraction, correction and deletion. If you wish to request access to, or correction or deletion of, personal information about you that we hold, you can contact us as described in the How to Contact Us section.

However, to the extent permitted by applicable law, we reserve the right to decline requests that are unreasonable, excessive, prohibited by law, could adversely affect the privacy or other rights of another person, or where we are unable to authenticate you as the person to whom the data relates.

Communications preferences. If you receive promotional email or SMS messages from us and would like to stop, you can do so by following the directions in that message. These choices do not apply to mandatory service communications that are part of our Consumer Service, or to surveys or other informational communications that may have their own unsubscribe method.

Cookie controls. Most web browsers are set to accept cookies by default. Instructions for blocking or deleting cookies may be available in your browser's privacy or help documentation. If you prefer, you can set your browser to delete or reject cookies. If you choose to delete or reject cookies, this could affect certain features or services of our website. If you choose to delete cookies, settings and preferences controlled by those cookies, including advertising preferences, may be deleted and may need to be recreated. See the Use of Cookies and Other Technologies section of this policy for more details.

Advertising and analytics. Our third-party analytics partners typically provide options to opt-out of certain information collection or use. See the Use of Cookies and Other Technologies section of this policy for more details.

Do Not Track. Some browsers have incorporated "Do Not Track" (DNT) features that can send a signal to the websites you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our websites do not currently respond to browser DNT signals. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls described above.

Security of Personal Information

We take precautions, including administrative, technical and physical measures, to safeguard your personal information against loss, theft, and misuse, as well as unauthorized access, disclosure, alteration and destruction. These precautions, like any information security program, may be circumvented or hacked, and we do not guarantee security.

In the event we provide you with the ability to enter personal credentials and a password to access our Services, to help us improve our data protection efforts we request that you use a strong password, never share your password with anyone or use the same password with other sites or accounts, and notify us immediately if you suspect any misuse of your username or password.

Location of Personal Information

The personal information we collect may be stored and processed in your country or region, or in any other country where we or our affiliates, subsidiaries, or service providers maintain facilities. Currently, we primarily use data centers in the United States. The storage location(s) are chosen in order to operate efficiently, to improve performance, and to create redundancies in order to protect the data in the event of an outage or other problem. We take steps designed to ensure that the data we collect under this policy is processed according to its provisions and applicable law wherever the data is located.

We transfer personal information from the European Economic Area and Switzerland to other countries, some of which have not been determined by the European Commission to have an adequate level of data protection. When we do so, we use a variety of legal mechanisms, including contracts, to help ensure your rights and protections. Retention of Your Personal Information
